Children Are Entitled to Necessary Services in School Regardless of Funding Challenges
Federal law requires schools provide the services students need to receive a free appropriate education in the least restrictive environment (FAPE).
Recent news of our state’s difficulties in implementing the Medicaid to Schools program are concerning but are not valid reasons to deny students’ access to necessary services. A school’s access to these funds does not affect its obligation to provide children with special education or the related services they require to receive FAPE.
While state lawmakers and stakeholders work to resolve outstanding issues relating to the Medicaid to Schools Program, all eligible children should continue to receive necessary services in accordance with federal law. No child should experience a reduction in services due to this funding challenge.
