Kate loves yoga. She loves the health benefits as well as the community connections she’s made. Yoga has become an important physical and social activity for her. At first, she paid for her classes through a temporary private grant but then she asked her Area Agency to pay as part of her services under the DD Waiver.
Kate’s Area Agency was not supportive at first. It asked for a letter from Kate’s doctor and therapist. Kate submitted letters from both providers. After receiving those letters, the Area Agency said it also needed a letter from a physical therapist. Kate then had to get a referral from her doctor to see a physical therapist. Although she was eventually able to see a physical therapist, she wasn’t able to get a third letter.
The Area Agency decided that it could not pay for the yoga classes without the third letter but failed to give this denial to Kate in writing. Without a written notice, Kate could not appeal the service denial. That’s when Kate reached out to us. Kate, along with her DRC-NH attorney, met with her Area Agency and liaison from the Bureau of Developmental Services. We were able to assist Kate in successfully arguing that since her classes were medically recommended by both her medical doctor and therapist, payment should be approved under the DD Waiver’s Wellness category.
Kate is now back to enjoying her yoga classes, fully welcome and included in her local yoga community.
